Del,

Basically you need to ask them to trim/lop thier tree/bush.  If they refuse, give in writing that you will undertake the work with an estimate from a tree surgeon.  If no action, as Peter says, trim/lop and cuttings returner to owner.

Check out cases involving Lalandii trees.

Then, growing old is compulsary, but growing up is just optional.

or just poison the tree assuming that it's not anything special, plead ignorance, and let them think they didn't water it properly :)

If you're touching trees please be certain that they are not covered by a Tree Preservation Order [TPO].

Fines can be up to £20,000 per tree, especially if unauthorised work results in death of a tree.

Your local Council will have records, some records are available online via the Council's website, which is usually www.[name of council].gov.uk

But as everyone else has stated you do have a right to cut overhanging bushes/trees.

Thanks for the responses chaps.

The item in question is not a tree, but a bush (conifer) about 5' tall that overhangs the driveway by about 2' - but a good warning there Landman.

And Brad, not a bad suggestion - I'll just Milo (one of my Labs) to p1ss on it a few times.  He has certainly killed the grass around the washing line   :P :P

I should perhaps expand a little.

In addition to individual trees & ornamental bushes/shrubs, there are also "group" TPO's, which may cover a small collection of trees.  Then there are also "Area" TPO's that can cover a large area, or even a whole suburb of a town.

So it's always well worth checking as ignorance is never a robust defense.

Cup of old engine oil from the last oil change should do the job ;)
